AUGUSTA COUNTY, VA (Rocktown Now) — The Augusta County man who was arrested last month following a pursuit has pleaded not guilty by reason of insanity.
According to online records, Scott Wayne Fitzgerald of Mount Sidney entered the plea during a hearing last week after being indicted by and Augusta County Circuit Court grand jury on two charges, including felony eluding.
A Notification of Mental Incompetence order was issued on Friday, May 29, 2026, and a review hearing has been set for August 4, 2026.
The case stemmed from a call back on March 9, 2026, about suspicious activity in the seven-hundred block of Elk Mountain Lane in the Afton area.
Upon arrival, deputies located the suspect vehicle and a pursuit began.
The chase led law enforcement through Rockbridge County and back into Augusta County before deputies successfully deployed tire deflation devices to disable the vehicle and the 34-year-old Fitzgerald was then taken into custody.
