NEWPORT NEWS, Va. – A prosecutor in Newport News revealed yesterday that the city will not press charges against the six-year-old boy accused of shooting first-grade teacher Abigail Zwerner.

Newport News Commonwealth’s Attorney Howard Gwynn said in an interview that the “prospect that a 6-year-old can stand trial is problematic.” He said a child that young wouldn’t have the required understanding of the legal system to be held liable.

Under current Virginia law, the child could have been charged for his actions.

No decision has been made as to whether any adults will be charged in the case.
