HARRISONBURG, Va. (ROCKTOWN NOW) – It appears that both the plaintiff and the defendants want Virginia’s attorney general to intervene in the lawsuit that was filed last month regarding the speed cameras located on East Market Street.
In a brief filed Tuesday in US District Court in Harrisonburg, the court has ordered that Jason Miyares defend the constitutionality of the statute.
Last month, Scott Boger, of Mount Jackson, filed the federal lawsuit against the city of Harrisonburg and several others after he received a ticket in July because the vehicle he owns was clocked traveling 44 miles per hour in the 25 mile-per-hour zone on Route 33 at the Interstate 81 interchange. His case was dismissed in General District Court and now he is seeking punitive and compensatory damages.
The court requested that Miyares inform them within 21 days whether he will seek to intervene.
