AUGUSTA COUNTY, VA (Rocktown Now) — Trespassing charges have been dropped against a man from Fishersville.
According to the Augusta County Sheriff’s Office, the County Commonwealth Attorney’s Office formally entered a nolle prosequi in the trespassing case against Zachary Cruz of Fishersville yesterday, effectively dismissing the charges.
Augusta County Commonwealth Attorney Timothy Martin stated that, after a thorough evaluation of the incident, “Zachary Cruz does not possess the capacity to form the criminal intent necessary to commit this offense.”
“I fully support the decision made by the Commonwealth Attorney’s Office to drop the trespassing charges,” said Sheriff Donald L. Smith. “Once we were able to determine that Mr. Cruz does not pose a threat, I feel this was the right course of action.”
Cruz is now receiving services for his mental health and intellectual disabilities.
