HARRISONBURG, Va. (ROCKTOWN NOW) – A Shenandoah County man has filed a federal lawsuit against the City of Harrisonburg over the speed cameras that are located on East Market Street.
Scott Boger of Mount Jackson filed the 12-page lawsuit yesterday in US District Court in Harrisonburg, naming the city as well as three other defendants.
Boger received a ticket back on July 9 after his vehicle was clocked traveling 44 mph in the 25 mph zone on Route 33 at the Interstate 81 interchange.
Boger appeared in Harrisonburg General District Court last Wednesday to argue that he was not the driver of the vehicle at the time and the case was dismissed.
He is now seeking compensatory and punitive damages as well as requiring the city to provide an accounting of funds collected through the speed camera program and issue restitution where appropriate.
