ROCKINGHAM COUNTY, VA (Rocktown Now) — A judge has dismissed the Rockingham County School Board and two other defendants from a 10-million-dollar lawsuit that was filed against them by a former Turner Ashby High School student.
In a 36-page opinion filed yesterday in U.S. District Court in Harrisonburg, Judge Jasmine Yoon granted the motion to dismiss, that was filed by the board, head principal at Turner Ashby Phil Judd, and guidance counselor Sandy King.
However, the judge did allow the lawsuit against former Turner Ashby choir director Wesley Dunlap to proceed to trial.
The 41-year-old Dunlap pleaded guilty back in May of 2021 to two counts of an indecent act with a child while in a supervisory capacity and was sentenced to two years in prison. He is currently on supervised probation, according to online court records.
The lawsuit was filed by the former student in July of 2021.
