NORFOLK, Va. (ROCKTOWN NOW) – Former House of Delegate Tim Anderson has filed a lawsuit challenging the constitutionality of the speed camera enforcement.

Anderson, who is an attorney from the Virginia Beach area, filed the suit in U.S. District Court in Norfolk on behalf of a Chesapeake resident who was issued a speed camera ticket.

According to a post on his Facebook page, Anderson stated that the action requests a variety of relief, but one specifically is a statewide injunction on speed camera prosecutions that violate the Sixth Amendment.

Speed cameras have been set up in Harrisonburg at the East Market Street construction zone at the Interstate 81 interchange. Questions about the camera’s constitutionality have been discussed since being implemented on this side of the commonwealth, as many drivers who received citations from the cameras have challenged their tickets in court.

Nearly 25,000 tickets were issued to drivers travelling through the East Market Street construction zone between September 2023 and March 2024. As of last month, more than 1,400 citations have been dismissed.
