HARRISONBURG, VA (Rocktown Now) — The city of Harrisonburg has scored a victory in the courts.

A federal judge has granted the city’s motion to dismiss a lawsuit filed by a Shenandoah County man over those speed cameras that are located on East Market Street.

Scott Boger of Mount Jackson filed the lawsuit last October after he received a ticket because his vehicle was clocked traveling 44 miles per hour in the 25 mile-per-hour zone on Route 33 at the Interstate 81 interchange.

In addition to the city, Harrisonburg Police Sergeant Wayne Westfall and City Attorney Wesley Russ were named as defendants in the lawsuit.

Boger argued that he was not the driver of the vehicle at the time, but U-S District Court Judge Jasmine Yoon issued a ruling Tuesday dismissing his lawsuit without prejudice.
